What is HIPAA?

HIPPA is an acronym for the federal Health Insurance Portability and Accountability Act .  This Act provides protections for patients' privacy rights. 

The HIPAA Authorization

A HIPAA Authorization is a document that allows your protected information to be disclosed to authorized individuals or entities. The Authorization will state the duration for which it is to remain in effect and may allow all records to be released, or may limit the information to be shared.  

Having a completed HIPAA Authorization will help you to have a complete estate plan.   As it relates to the preparation of your Life and Legacy Plan, provisions to access to the entire medical record is commonplace, while a HIPAA authorization for alternate reasons, such as review and evaluation is support of a legal claim, may be limited to a specific injury, specific treatment, or specific scope of time.  

Rights and Duties under HIPAA

Pursuant to HIPAA, Health Care Providers have a duty to protect your medical information from disclosure, except as otherwise permitted by law.  HIPAA also affords you rights, as a patient, to access and update your medical records, and dictate how Health Care Providers may communicate with you.

When is the best time for me to complete my HIPAA Authorization?
