Health Care Power of Attorney

What is a Health Care Power of Attorney in New Jersey?

In New Jersey , a Health Care Power of Attorney, is one part of your Advanced Health Care Directive.  It is the proxy directive, in that it authorizes someone you trust to act on your behalf instructing your health care professionals regarding what care you permit or reject.  A proxy directive  becomes operative when and if you are unable make the decision yourself.

Who Should I Choose to be My Health Care Power of Attorney?

You should select someone who you trust as your Health Care Power of Attorney.  They should be aware of your wishes, and be willing to abide by them.  If you also have a Living Will, your Health Care Power of Attorney must comply with those instructions.

When is the best time for me to Create a Proxy Directive?

Now!  It is best to have a proxy directive in place before you need one.  Once a health care emergency occurs, your family will be left to guess and decide what care you would want.  This can create turmoil when there is disagreement or uncertainty surrounding those decisions, and adds emotional burden to an already difficult time.
